Mr. Rajesh Singh, learned Counsel appearing on behalf of the appellant/Insurance Company submits that one of the claimant, being claimant No. 3 did not collect his cheque from learned Tribunal as per order dated December 09, 2017 passed by the National Lok Adalat. He further submits that the respondent No. 3 is suffering from certain medical disability and is accordingly not be able to approach the Tribunal for collecting the cheque. He submits that the Insurance Company is ready and willing to transmit the sum through NEFT/RTGS directly to the bank account of the respondent No. 3.
Learned Counsel for the respondents/claimants is present in Court today and is ad idem with the submissions made by Mr. Rajesh Singh.
In the light of the above submissions, the Insurance Company is directed to transmit the awarded sum directly by way of NEFT/RTGS to the bank account of the claimant/respondent No. 3.
Upon making such payment to the claimant/respondent No. 3, the Insurance Company is given liberty to withdraw the cheque issued in favour of the respondent No. 3 lying with the said Tribunal. Accordingly, the application for modification, being IA No. CAN 4 of 2019 (Old No. CAN 4281 of 2019) stands disposed of.
Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of all formalities, on priority basis.
