1. The supplementary affidavit filed in Court today on behalf of the applicants is taken on record.

2. Mr. Bera, learned advocate appearing on behalf of the applicants by placing the aforesaid supplementary affidavit submits that Shri Purnendu Kumar Maji (I.A.S.), District Magistrate, Purba Medinipur, Nimtouri, Tamluk, Purba Medinipur, PIN: 721648 is the new incumbent to the post of District Magistrate, Purba Medinipur. As such, he seeks leave to add the new incumbent as the added contemnor in the present contempt application.

3. Considering such prayer leave is granted to the applicants advocates on record to add Shri Purnendu Kumar Maji as a contemnor.

4. Although, by order dated August 26, 2022, a Coordinate Bench of this Court despite observing that the matter deserves issuance of rule of contempt against the alleged contemnors, however, in the light of

the stand taken by the contemnors, while directing the alleged contemnors to file compliance report disclosing payment of a sum of Rs.1 crore 44 lakhs equally between the two petitioners plus 50 per cent incentive to each of the petitioners had deferred issuance of the rule, but no such compliance report is found in the record.

5. Mr, Bera representing the applicants would further submit that the aforesaid order August 26, 2022 has not been complied with and the applicants have not been disbursed their legitimate entitlement.

6. In view thereof, while directing the department to file a report as to whether any compliance report has been filed on behalf of the alleged contemnors in terms of the order dated August 26, 2022, I direct the applicants to effect service of the contempt application on the alleged added contemnor.

7. Let this matter stand adjourned and be taken up for further consideration in the Monthly List of August, 2024.
