1. Learned Advocate appearing for the petitioner submits that the subject matter of alleged recovery in the present case is 34.262 kgs of ganja. However, the charge-sheet has been submitted but the chemical examiner's report is yet to be submitted.

2. Learned Advocate appearing for the State opposes the prayer for bail in view of the quantum of seizure which has been effected in the present case.

3. Having regard to the aforesaid I am of the view that rigors of Section 37 of the NDPS Act is attractive. As such the prayer for bail of the petitioner is rejected.

4. Learned Trial Court would ensure that the chemical examiner's report is made available within a period of 45 days from the date of communication of this order.

5. The Trial Court would thereafter overcome the stage of consideration of charges and give priority to the examination of the seizure list witnesses. Let the subsequent procedure of the evidence of the seizure list witnesses be completed within a period of three months from the date of the charges being framed.

6. Accordingly, C.R.M (NDPS) 1251 of 2026 is dismissed at this stage.

7. Memo of evidence submitted be kept with the record.

8. All parties shall act in terms of server copy of the order downloaded from the Official website of this Court.

9. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
