Learned advocate appearing for the petitioner submits that the petitioner was intercepted on alleged recovery of 2568 gms of Ganja from the Calcutta Airport. Complaint has already been filed to the jurisdiction Court. As such, the petitioner prays for bail.

Learned advocate for the Customs Authority opposes the prayer for bail.

Having considered the judgment of the Hon'ble Supreme Court rendered in the case of Barnali Bag -vs- Union of India [Special Leave Petition (Crl.) No.3641 of 2026] wherein

emphasis was made on the issue of intermediate quantity, I am inclined to release the petitioner on bail. 4.

Accordingly, the prayer for bail of the petitioner is allowed. 5.

As such, the petitioners, namely, Yakoob Valiyathodi Paramba alias Yakob Valyathodi Paramba shall furnish bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (NDPS Act), 8th Court at Barasat, North 24 Parganas.

If on bail, the petitioner shall make himself before the Investigating Officer or any Officer assigned by the Principal Officer of Customs Authority of Airport, as and when called for.

Accordingly, CRM(NDPS) 1335 of 2026 is disposed of. 8.

Case diary be returned to the learned advocate appearing for the State.

All parties shall act on the basis of server copy of this order duly downloaded from the official website of this Court.

10. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
