1. Learned Advocate appearing for the petitioner submits that the petitioners are in custody for more than five and a half months and charge-sheet has already been submitted. The trial of the case will consume substantial time. As such the petitioners may be released on bail.
2. Learned Advocate appearing for the State opposes the prayer for bail and submits that the recovery in the present case is 1 kg 812 gms of brown sugar.
3. Having considered the rigors of Section 37 of the NDPS Act is attracted I am not inclined to release the petitioners on bail. As such, prayer for bail of the petitioners in CRM (NDPS) 1325 of 2026 is rejected. Petitioners, however, shall renew their prayer for bail after the evidence of the seizure list witnesses are over.
4. Accordingly, C.R.M (NDPS) 1325 of 2026 is dismissed.
5. Memo of evidence submitted be kept with the record.
6. All parties shall act in terms of server copy of the order downloaded from the Official website of this Court.
7. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
