1. Learned Advocate appearing for the petitioner submits that the petitioner is in custody for 3 years 2 months and till date only one witness has been completed by the prosecution out of the 14 witnesses cited.

2. Learned Advocate for the State on the other hand opposes the prayer for bail and contends that there has been seizure of 2.5 kgs of morphine. Five accused persons are involved in the case and the case records would show that on majority of the dates although P.W. 1 was present but after the examination-in-chief the defence continuously took time which resulted in delay of the case.

3. I have taken into account the quantum of recovery and the contribution of the delay which was at the instance of an advocate appearing for the accused.

4. Having considered the same I am not inclined to release the petitioner on bail in connection with CRM (NDPS) 1327 of 2026.

5. Accordingly, C.R.M (NDPS) 1327 of 2026 is dismissed.

6. Memo of evidence submitted be kept with the record.

7. All parties shall act in terms of server copy of the order downloaded from the Official website of this Court.

8. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
