1. Affidavit-of-service filed on behalf of the petitioner is taken on record.
2. Matter is heard in presence of the learned advocates representing the petitioner, State respondent and respondent nos.5 and 6.
3. By presenting this writ petition, inter alia, petitioner has prayed for implementation of the order dated 16th May, 2023 passed by the jurisdictional authority under the Protection of Women from Domestic Violence Act, 2005 (hereinafter referred to as the said Act of 2005).
4. Issue of implementation of the order passed by the jurisdictional authority under the said Act of 2005 is decided by this Court in another writ petition being WPA 11856/2026 (Ruma Roy vs. State of West Bengal & Ors.). It was decided therein that High Court while exercising writ jurisdiction under Article 226 of the Constitution of India is not the appropriate forum for implementation of the order passed by the jurisdictional authority in a proceeding initiated under the relevant provisions of the said Act of 2005. If the petitioner finds order passed under the said Act of 2005 is not being implemented, steps are required to be taken within the four corners of the statute, i.e., Protection of Women from Domestic Violence Act, 2005.
5. Hence, writ petition is not entertained and same stands dismissed.
