Mr. Prasad Bhattacharyya ..for the petitioners Mr. Madhu Jana Mr. Pratap Kumar Yadav ...for the State On the prayer of the petitioners, liberty is granted to expunge the names of respondent nos. 8 to 23 from the cause title of the writ petition. The cause title be amended accordingly.

Affidavit of service filed by the petitioner is taken on record.

The petitioners are members of Baduria Panchayat Samity and submitted a no confidence motion for removal of the Sabhapati of the Samity being the 5th and 6th respondents herein before the Prescribed Authority on June 18, 2026 which was received by the latter on the same date. By a notice issued on June 23, 2026 the Prescribed Authority/ Sub-Divisional Officer, Basirhat fixed the date of meeting on July 07, 2026. The petitioners seek a direction upon the police authority to render necessary assistance to the Sub-Divisional Officer, Basirhat so that the meeting is held without any hindrance.

The prayer of the petitioners is innocuous.

Since the meeting has been fixed on July 07, 2026, the Officer in Charge, Baduria Police Station, being the 24th respondent herein, is directed to render necessary assistance to the Prescribed Authority and Sub-Divisional Officer, Bashirhat, being 3rd respondent herein, so that the meeting is held peacefully and without any disturbance from any corner whatsoever.

The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
