IN THE HIGH COURT AT CALCUTTA

Constitutional Writ Jurisdiction Appellate Side.

----------- WPA 21463 of 2021 27.12.

Ct. No. 17 Ab & Saswata M. R. Charitable Trust Vs.

The State of West Bengal and others.

--------------- Mr. Prabal Kumar Mukherjee, Ms. Shebatee Datta, Ms. Shaoni Dey.

... for the writ petitioner.

Mr. Himadri Sekhar Chakraborty, Mr. Bipin Ghosh.

... for the State Mr. Nilotpal Chatterjee ...for the INC Affidavit of service filed in Court today is kept with the record.

In view of the common issue involved regarding the admission process in the nursing course for the session 2021-2022, a Coordinate Bench in WPA 21211 of 2021 passed a direction categorically restraining the respondent authorities from taking any steps in terms of the impugned order dated 30th November 2021 with reference to the petitioner.

By the same order the Indian Nursing Council was granted liberty to proceed with the inspection as mandated under the relevant statute.

In view of such order being not challenged in appeal by any of the respondents till date, I am of the opinion that the petitioner is covered by the order dated 24th December 2021 passed in WPA 21211 of 2021.

As such, the admission process which is to be

completed by 31st December 2021 should continue for the session 2021-2022 subject to the terms as laid down in the order dated 24th December 2021 (passed in WPA 21211 of 2021).

With the aforesaid observations, the writ petition being WPA 21463 of 2021 is accordingly disposed of. Parties to act on the basis of the server copy of this order downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
