CPAN 1000 of 2021 in WPA 25228 of 2018 Nemai Pal & Ors.

vs.

Dr. P. Deepap Priya S/L No.28 12.08.2022 Ct-29 (AD) Mr. Panchanan Hajra ...for the petitioners.

Mr. T.M. Siddiqui Mr. Nilotpal Chatterjee ... for the alleged contemnor.

Petitioners complain of the violation of the order dated December 20, 2018.

By such order, respondent no.3 in the writ petition was directed to consider and decide the representation made by the petitioners in accordance with law. Alleged Contemnor is represented.

On behalf of the alleged contemnor, an order dated January 2, 2020 is relied upon.

Apparently, the authorities acted in terms of the order dated December 20, 2018.

It is contended on behalf of the petitioners that the order dated January 2, 2020 is not in accordance with the order dated December 20, 2018 passed by the High Court.

In view of the alleged contemnor passing the order dated January 2, 2020, it cannot be said that the alleged contemnor acted in wilful violation of the order of the High Court.

The contentions with regard to the order dated January 2, 2020 are kept open.

CPAN 1000 of 2021 is disposed of accordingly. (Debangsu Basak, J.)
