1. Heard learned counsel appearing on behalf of the petitioner and the learned counsel for the State who has placed the case diary.

2. It appears from the materials on record, the statement of the eyewitnesses and statement recorded under Section 164 of the Code of Criminal Procedure, that the petitioner herein is the principal accused and has played a specific role in the offence which led to death of an aged person due to alleged assault.

3. It is submitted that charge-sheet has been submitted and the charge has also been framed.

4. Considering the fact that the trial in the present case has commenced and considering the nature of offence alleged, the court is not inclined to consider the prayer for bail of the petitioner at this stage. Accordingly, the prayer for bail made by the petitioner is accordingly rejected.

5. The application for bail is accordingly disposed of.

6. Urgent photostat certified copy of this order, if applied for, be

given to the parties, upon compliance of all requisite formalities. (Shampa Dutt (Paul), J.)
