23.12.2022 sdas rejected C.R.M.(DB) No. 4584 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Daspur Police Station Case No. 158 of 2022 dated 30.04.2022 under Sections 376/506/500 of the Indian Penal Code and Section 6 of the Protection of Children from Sexual Offences Act and Sections 66E/67A of the Information Technology Act, 2000 and in POCSO 23/2022.

And In Re : Sadhu Dutta @ Sidhu .... petitioner Mr. Kapil Chandra Sahoo ....for the petitioner Mr. Sudip Ghosh Mr. Apurba Kr. Datta Mr. Bitasok Banerjee ...... for the State Learned counsel appearing for the petitioner submits petitioner is in custody for 235 days. It is also submitted by the learned counsel on behalf of the petitioner there was a love affair between the parties.

It is further submitted that victim was minor at the time of occurrence.

State opposes prayer for bail and submits petitioner has blackmailed the victim by uploading objectionable pictures on social media.

Under such circumstances and in view of the gravity of offence, we are not inclined to grant bail to the petitioner. Accordingly, prayer for bail is rejected.
