24.12.2025 Court No.28 Item No. 46 tbsr reject CRM (A) 4384 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliganj P.S. Case No. 856 of 2025 dated 19.10.2025 under Sections 109/117(2)/126(2)/304(2)/3(5) of the BNS, 2023. And In the matter of : Sagir Ali Dafadar @ Sagir Dafadar ....Petitioner.

Mr. Manas Kumar Das Mr. Asraf Mandal ....for the petitioner.

Mr. Imran Ali Ms. Srilekha Chatterjee .....for the State.

Learned counsel appearing on behalf of the petitioner submits that there was free fight between two groups. Both sides received injuries, but none was grievous injury. There are case and counter case.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He refers to the statements of witnesses including the victim and the injury report, which shows infliction of cut injury on the frontal region of the scalp. Considering the incriminating materials available in the case diary and the alleged role ascribed to the present petitioner, I do not consider this to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
