Heard the learned Counsel appearing on behalf of the petitioner and the learned Counsel for the State. Perused the case diary.

The petitioner has been implicated in the present case on the statements of the witnesses and he was not FIR named accused though identified in Test Identification Parade.

The petitioner claims bail on parity with accused Suman Nath granted bail in C.R.M (NDPS) 1609 of 2025 vide order dated 17th December, 2025.

It appears from the case diary that the investigation in the present case has been completed and 67 kilograms of Ganja was recovered from the possession of the accused persons and he is in custody for about one year. 5.
It further appears from the case diary that trial has commenced in the present case.

Considering the nature of the offence and in view of the fact that one of the co-accused persons has been granted bail by a Co-ordinate Bench of this Court, this Court is inclined to grant bail to the petitioner on parity. 7.
Accordingly, the petitioner, Ujjal Parui, shall be released on bail upon furnishing a bond of Rs. 20,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Judge, 3rd Special Court under NDPS Act, Burdwan, subject to the condition that the petitioner shall appear before the Trial Court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever and on further condition that he shall not leave the jurisdiction of the Trial Court and shall provide a local address and mobile number of the Investigating Officer of the case as well the Trial Court and shall not leave the said jurisdiction without prior permission of the Court in case of emergency. 8.
In the event he fails to appear before the Trial Court without any justifiable cause, the Trial Court shall be at liberty to cancel his bail automatically without reference to this Court.

The application being C.R.M.(NDPS) 1746 of 2025 is disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of necessary formalities.
