Re: CPAN 640 of 2024 This is an application alleging willful violation of the order dated December 29, 2023 passed in CAN 1 of 2023 arising out of FMAT 583 of 2023.
Mr. Roy, learned Advocate appears for the alleged contemnors.
Let affidavit-in-opposition to the contempt application be filed within a week after reopening of
this court after Christmas Vacation; reply thereto, if any, be filed within two weeks thereafter.
Parties will be at liberty to mention the matter for inclusion in the list after expiry of the time fixed for exchange of affidavits.
Mr. Roy, learned Advocate appearing for the alleged contemnors submits that the hearing of the injunction application is being adjourned on the ground of pendency of this contempt application. It is, however, made clear that pendency of the contempt application shall not preclude the learned Trial Judge from proceeding with the hearing of the pending applications or the suit in accordance with law.
Re: CPAN 1467 of 2024 Since Mr.
Roy, learned Advocate is representing the alleged contemnors in CPAN 640 of 2024, the petitioners are directed to serve a copy of this application upon the learned Advocate-onRecord of the alleged contemnors. The copy of such application has already been handed over to the learned Advocate-on-Record of the alleged contemnors in court today.
List this contempt application along with CPAN 640 of 2024.
