Heard the learned Counsel appearing on behalf of the petitioner and the learned Counsel for the State. Perused the case diary.

The petitioner herein is the driver of the vehicle in which 81 kilograms of Ganja was recovered. The petitioner is in custody for one year.

It appears from the case diary that charge-sheet has been submitted and trial has commenced.

Considering the nature of the offence and the long detention in custody, this Court is inclined to grant bail to the petitioner.

Accordingly, the petitioner, Khusbar Ali Sk. @ Khusu @ Chottu, shall be released on bail upon furnishing a bond of Rs. 20,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Judge, 3rd Special Court under NDPS Act, Burdwan, subject

to the condition that the petitioner shall appear before the Trial Court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever and on further condition that he shall not leave the jurisdiction of the Trial Court and shall provide a local address and mobile number of the Investigating Officer of the case as well the Trial Court and shall not leave the said jurisdiction without prior permission of the Court in case of emergency.

In the event he fails to appear before the Trial Court without any justifiable cause, the Trial Court shall be at liberty to cancel his bail automatically without reference to this Court.

The application being C.R.M.(NDPS) 1749 of 2025 is disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of necessary formalities.
