(Rejected) CRM (NDPS) 2105 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure filed on 27.12.2023 in connection with Nimta P.S. Case No.126 of 2022 dated 26.02.2022 under Section 21(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

The learned counsel appearing on behalf of the petitioner submits that this accused is in custody for one year and ten months. Considering the period of detention, he prays for granting bail. He further submits that evidence has not yet been started in spite of charge being framed long ago. 2.

Learned counsel appearing on behalf of the State opposes the prayer for bail and submits that the contraband substance is of commercial quantity and he further submits that the next dates for evidence are of 11th January, 2024 and 15th January, 2024.

Considering the fact that the contraband substance is of commercial quantity and also considering the fact that the dates fixed for evidence are on 11th January,

2024 and 15th January, 2024 and also considering the provision of Section 37 of the NDPS Act, prayer for bail is rejected at this stage.

The learned Trial Judge is requested to expedite the trial and to complete the same within six months from the next date.
