The learned counsel appearing on behalf of the petitioner submits that the petitioner is languishing in custody for more than one and a half year and only few witnesses have been examined. Considering the period of detention, he prays for bail.

Learned Additional Public Prosecutor appearing on behalf of the State opposes the prayer for bail and submits that the contraband substance is of commercial quantity. He further submits that three of the witnesses named in the charge sheet have already been examined and the next dates fixed are on 16th January, 2024 and 17th January, 2024. 3.

Considering the contraband substance recovered is of commercial quantity and considering the fact that the trial

has also commenced and three out of ten witnesses have already been examined and also considering the provision under Section 37 of the NDPS Act, the prayer for bail is rejected at this stage.
