Learned Counsel appearing for the petitioner submits that coaccused Mithun Mondal has been granted pre-arrest bail. Learned Counsel appearing for the State produces the case dairy.

We have considered the nature of allegation and extent of complicity of the petitioner in the alleged crime in the light of the aforesaid submission that co-accused has been granted pre-arrest bail.

Hence, we are inclined to extend the same privilege to the petitioner also.

Accordingly, we direct that in the event of arrest, the petitioner be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
