24.12.2020 Sl. No.49 akd [Rejected] C. R. M. 10674 of 2020 [via video conferencing] In Re: An application for bail under Section 439 of the Code of Criminal Procedure filed on 15.12.2020 in connection with Basanti Police Station Case No.100(2) of dated 24.02.2014 under Sections 396/397/412/120B of the Indian Penal Code.

And In Re: Kutubuddin Laskar ... ... Petitioner Mr. Bitasok Banerjee .. Advocate Mr. Biswajit Mitra .. Advocate ... ... for the petitioner Mr. Madhusudan Sur .. Ld. Addl. Public Prosecutor Mr. Manoranjan Mahata .. Advocate ... ... for the State It is submitted on behalf of the petitioner that he is in custody for more than six years. It is further submitted that co-accused is on bail. Learned Additional Public Prosecutor opposes the prayer for bail and submits that the trial is at its fag end. We have considered the materials on record. Allegations are grave and include dacoity with murder. Trial is at its fag end. Under such circumstances, we are not inclined in granting bail to the petitioner at this stage.

The application for bail is thus rejected.

Trial court however, is directed to conclude the trial at an early date preferably within three months from the next date fixed for recording evidence without granting unnecessary adjournment to either of the parties.
