In the matter of : Raj Dulal Sarkar ..... petitioner Mr. Kaustav Bagchi Mr. Amanul Islam ....For the petitioners Mr. Rana Mukherjee Mr. Bitasok Banerjee .....For the State Counsel appearing for the parties agree that the charge-sheet filed under Section 195-A of the IPC would have to be treated as an independent proceedings and that the petitioner has already been released on bail.
On the stated position of the parties, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only) with two sureties of like amount to the satisfaction of the arresting officer. The petitioner shall be subject to the conditions under Section 438(2) of The Code of Criminal Procedure and the petitioner shall not enter the jurisdiction of the Tehatta Police Station while the investigation is going on. The petitioner will also regularly attend Court hearings which may be required under the circumstances and shall also report to the Officer-inCharge of the Tehatta Police Station as and when required.
