Affidavit-of-service filed on behalf of the petitioner is taken on record.
Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is a graduate and is a TET qualified. She is an aspirant for the post of assistant teacher in terms of the notification dated 23.12.2020 issued by the West Bengal Board of Primary Education. As per
the said notification the petitioner tried to fill up the form. However, she found that a verification code was to be put in, which was not available to her. The last date for submission of the application form online is 06.01.2021. On inquiry she learnt that earlier another notification was issued on 23.11.2020 whereby a verification code was to be obtained for which the last date was 01.12.2020. Since she is a TET qualified and otherwise eligible for the post, the petitioner may be granted an opportunity to fill up the form ofline or given the necessary code. Learned counsel appearing for the respondent nos. 2,3 and 4 submits as follows. As would be evident from paragraph 12 of the writ application, the petitioner missed the earlier notification while the other applicants did not.
A number of candidates have applied for the post online following the procedure laid down by the two notifications. The petitioner did not even opt for accessing the help line, which is provided in the subsequent notification. However, as a one off case, the office of the Board may consider the petitioner's application for filling up the form ofline.
I have heard the submissions of the learned advocates of the appearing parties and have perused the writ application.
It appears that the earlier notification clearly provided for applying for a verification code. While the other candidates have obtained the same, the petitioner did not do that. The entire procedure cannot ordinarily be altered for the benefit of a single individual who has not taken due care in applying for a post.
However, since the petitioner is otherwise qualified for the post and TET qualified as well and considering the submissions made on behalf of the respondent nos. 2, 3 and 4, the petitioner shall be at liberty to approach the Office of the concerned Board praying for permission to fill up of the necessary form off-line and the same has to be done by 04.01.2021. If such application is made within the stipulated time, the concerned authority shall consider it in accordance with law. With these observations, the writ application is disposed of.
The concerned authorities shall act on a copy of the order downloaded from the official website of the Court.
