Rejected CRM 11291 of 2020 (Through Video Conference) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kalyani P.S. Case No.345 of 2019 dated 14.08.2019 under Section 6 of the Protection of Children from Sexual Offences Act, 2012.

And In the matter of: Chandranath Majhi .... Petitioner Mr. Shibaji Kumar Das ... For the Petitioner Mr. Swapan Banerjee, Mr. Purnima Ghosh ... For the State The petitioner prays for bail on the ground of the petitioner's advanced age, in connection with a proceeding under Section 6 of the Protection of Children from Sexual Offences Act, 2012. Learned counsel for the State submits that the victim was a minor child of tender years and relies on the medical report filed in connection with the alleged offence. The said report, needless to say, is a part of the case diary.

In view of the gravity of the offence, we feel that the petitioner ought not to be granted bail at this stage.

Accordingly, CRM 11291 of 2020 is dismissed.

Urgent photostat certified copy of this order, if applied for, be made available to the petitioner upon compliance of all requisite formalities.
