The petitioner is an accused person in connection with G.R.Case No. 1060 of 2026 arising out of Samuktala Police Station Case No. 170 of 2026 dated 16.05.2026 under Sections 126(2)/117(2)/118(2)/109/3(5) of Bharatiya Nyaya Sanhita, 2023 pending before the learned Chief Judicial Magistrate at Alipurduar, District-Alipurduar. 2.

Mr. Rakshit, learned advocate for the petitioner has submitted that other co-accused has already been released on bail. The petitioner being similarly circumstanced does also deserve similar order on the ground of parity. 3.

Having perused the materials in C.D. and particularly the injury reports, the submission made on behalf of the

petitioner does not inspire confidence in the mind of Court insofar as the petitioner has been alleged to be directly involved in causing sharp cutting injury at the vital part of body of the victim, at his head.

The same is apparent from the medical report as well as the statement of the witnesses.

In such view of the serious materials the petitioner's bail prayer stand rejected.
