23.12.2019 sdas rejected C.R.M. 12251 of 2019 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 20.12.2019 in connection with Sahebgunj Police Station Case No. 348 dated 12.07.2019 under Sections 20(b)(ii)(c ) of the NDPS Act.

And In Re : Supriya Chaki ..... petitioner Mr. Ayan Basu, Mr. Prabir Kumar Das, Mr. Sourav Bera, Mr. Sumit Routh ... for the petitioner Mr. Sanjoy Bardhan, Mr. C. R. Ghosh ... for the State It is submitted by the learned Counsel appearing for the petitioner that she is a lady and executed the power of attorney in favour of the co-accused Prodip Kumar Mondal to ply the vehicle in question.

Learned Counsel appearing for the State opposes the prayer for anticipatory bail and submits that the vehicle was used for transportation of narcotic substance which is above commercial quantity.

We have considered the materials on record. We note the said Prodip Kumar Mondal is an accused in the present case. Involvement

of the petitioner as a conspirator in the crime cannot be wholly ruled out.

In view of the gravity of the offence and her prima facie involvement in the alleged crime, we are of the opinion that this is not a fit case to grant anticipatory bail.

Accordingly, prayer for anticipatory bail is rejected. (Suvra Ghosh, J.) (Joymalya Bagchi, J.)
