Mr. Asis Bhattacharyya, learned counsel appears for the petitioner.

Mr. Biswabrata Basu Mallick, learned Additional Government Pleader appears for the respondents. Referring to a Memo dated February 11, 2011 issued by the respondent No. 6 at page 37 to the writ petition, learned counsel appearing for the petitioner contends that though the petitioner had applied for obtaining M.R. Dealership licence in terms of the said Memo, neither the State authority has appointed any M.R. Dealer nor has even informed the fate of the application of the petitioner. Learned counsel for the writ petitioner then refers to a representation of the

petitioner dated December 1, 2023 at page 46 to the writ petition made through the letter of her learned advocate and submits that even then the petitioner has not yet received any information as to the fate of her application.

Learned Additional Government Pleader submits that the Memo was issued in February, 2011 and the writ petition has been filed in 2023. Hence, no relief can be granted to the petitioner at this stage. Considering the rival contentions of the parties and considering the materials on record, the respondent No. 6 is directed to inform the petitioner as to the fate of the application of the petitioner appearing at page 17 to the writ petition positively within a period of four weeks from the date of communication of this order. It is made clear that this order shall not create any right or equity in favour of the petitioner in any manner and the respondent No. 6 shall only intimate the fate of the application in writing to the petitioner. Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.

On the above terms, this writ petition WPA 2966 of 2023 stands disposed of, without any order as to costs.
