Versus

THE KOLKATA MUNICIPAL CORPORATION AND ORS.

BEFORE:

The Hon'ble JUSTICE AMRITA SINHA Date : 31st December, 2020.

[Vacation Bench] Appearance:

Mr.R.N.Chakraborty, Adv.

..for the petitioner Mr.Swapan Debnath, Adv.

Mr.Gopal Chandra Das, Adv.

..for KMC Mr.Arindam Mondal, Adv.

..for the respondent no.7 The Court: Both the writ petitions are taken up analogously and disposed of by this common order.

The petitioner has averred in the writ petitions that there has been massive illegal construction in the premises no.66, Biplabi Rash Behari Bose Road, Kolkata-700 001, formerly known as Canning Street, Kolkata- 700 001. The prayer of the petitioner is two-fold. First, she prays protection from demolition of the unauthorized construction, allegedly done by the tenants behind her knowledge, and second, for apportionment of property tax. The Court was not satisfied with the submissions advanced by the petitioner.

Confronted with the queries of the Court, the petitioner seeks liberty to withdraw the writ petition on the ground that certain wrong annexures have been included in the writ petition.

The Court permits the petitioner to withdraw the writ petitions and file the same afresh with proper particulars.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon completion of usual legal formalities. (AMRITA SINHA, J.) D.Ghosh/TO
