The Court : This is an application by the executor under a Will, the probate of which was granted by this Court on 4th February, 2015. Despite there being a mandate in the grant for filing of inventory and accounts within a period of six months from the date of the grant, the executor has failed to do so.
It is submitted on behalf of the executor that everything has been done including ascent to the legacy for all the movable and immovable properties being the subject matter of the grant save and except the Savings Bank Account being Account No.038600000594 maintained with HDFC Bank at 31, Ganesh Chandra Avenue, Kolkata-700 013. It is also submitted that despite best endeavour the executor is
unable to collect information from the said Bank pertaining to the aforesaid account.
Considering the averments made in the said petition and the submission made on behalf of the executor, the time to file the inventory and accounts pertaining to the probate granted on 4th February, 2015 is peremptorily extended till 31st March, 2021.
It is made clear that no further extension of time shall be granted to the executor if he fails to file the inventory and accounts within the extended period of time. Nothing further remains to be adjudicated in the application.
Since I have not called for any affidavit, all allegations contained therein are deemed not to have been admitted.
The application is, accordingly, disposed of. There shall be no order as to costs.
