Learned advocate for the appellants states that all the legal representatives of deceased respondent No.7 are on record and seeks leave to delete the name of respondent No.7. 2.

Permission is granted to delete the name of respondent No.7.

Respondent No.11 has expired on 13th October 2025. Legal representatives of respondent No.11 are served. The application is filed within limitation.

The present applicants are legal heirs and as such legal representatives of deceased Manikrrao Rama Salam (Aatram) who was appellant No.1 in Regular Civil Appeal No.599 of 2017 decided by the learned District Judge, At Nagpur vide judgment and decree dated 24th January 2025. It is stated in the application that appellant No.1 had expired on 17th February 2024 and the appeal was decided without bringing his legal representatives on record.

Since the applicants are legal heirs of deceased appellant No.1 in Regular Civil Appeal No.599 of 2017, the application for leave to file second appeal is allowed.

The question whether Civil Appeal No. 599 of 2017 stands abated in its entirety or only qua deceased Appellant No. 1- Manikrrao Rama Salam (Aatram) is kept open. 9.

List the appeal for hearing on admission.
