The Applicants seek condonation of delay of 9 years and 141 days in filing the present Appeal. The reasons for the delay are set out in paragraphs 2 and 3 of the Application. It appears that the impugned Judgment and Award was passed on 24 November 2015, whereas the application for a certified copy thereof was made only on 2 November 2018. Though the certified copy was made ready for delivery on 23 November 2018, there is no
61-fa-st-24232-2025 with connected.doc explanation for the period thereafter till 9 October 2023. The explanation furnished is that an opinion of the Law and Judiciary Department, Mantralaya, Mumbai, was sought regarding the filing of the Appeal.

However, even thereafter, the present Appeal came to be filed only in June 2025.

In my view, there is no satisfactory explanation for the delay of nearly three years from the date of the Award till the application for obtaining a certified copy was made. Further, there is no explanation whatsoever for the period between November 2018 and October 2023. Even thereafter, no sufficient cause is shown for the delay in filing the Appeal. The Applicants have thus failed to make out a case for condonation of delay.

In the circumstances, the Application for condonation of delay is rejected.

In view of the rejection of the delay condonation application, the First Appeal as well as the Interim Application for stay do not survive and are accordingly disposed of.
