Applicant seeks bail in connection with Crime No. 910 of 2024, registered with Hill Line Police Station, Ulhasnagar, Dist. Thane, for the offences punishable under Sections 109, 238, 115(2), 352, 3(5) of Bhartiya Nyaya Sanhita, 2023 (for short "BNS") and an offences under Sections 37(1)(a) & 135 the Maharashtra Police Act.

In short, it is a case of the prosecution that on 28th December 2024 an incident occurred in which the injured was assaulted by the present Applicant. The said assault was caused with knife. Injured was taken to the hospital. According to the investigating agency, it was attempt to commit murder of the injured and hence offence punishable under Section 109 of BNS came to be attracted as against the Applicant.

Learned Counsel for the Applicant submits that now after completion of investigation, chargesheet has been filed and as such applicant cannot be kept in jail by way of pre-trial sentence. He makes statement that Applicant has no criminal history.

Learned APP opposes the application by pointing out specific allegations against the Applicant of causing assault with knife on the injured. Reference is also made to the injury certificate in order to support the said circumstances. 5.
Perusal of the record indicates that on conclusion of investigation, chargesheet has been filed. Applicant has no criminal history. As rightly argued on behalf of the Counsel for the Applicant that he cannot be kept in jail by way of pre-trial sentence. He is not likely to abscond if enlarged on bail. Hence, order.
ORDER
i) Criminal Bail Application stands allowed in connection with with Crime No. 910 of 2024 registered with Hill Line Police Station, Ulhasnagar, Dist. Thane, for the offences punishable under Sections 109, 238, 115(2), 352. 3(5) of Bhartiya Nyaya Sanhita, 2023 and an offences under Sections 37(1)(a) & 135 the Maharashtra Police Act.
ii) The Applicant be enlarged on bail, on furnishing P. R. Bond of Rs.15,000/- with one surety in the like amount, to the satisfaction of the Trial Court.
iii) The Applicant not to contact victim or any witness in any manner, whatsoever.
iv) Applicant to attend all dates of hearing before the Trial Court, unless exempted by specific order. v) Any breach of the aforestated condition shall result forthwith into cancellation of bail.

In view of the above, Application stands allowed and disposed of accordingly.

It is clarified that the above observations are made on prima facie consideration of the material on record and the same shall not bind the parties during the final hearing of the Trial Case.
