Heard learned counsel for the Applicant and learned APP for the Respondent-State.

The Applicant has approached this Court seeking regular bail in connection with Crime No. 294 of 2017 registered with Pangari Police Station, Solapur Rural, for the offences punishable under Sections 302, 307, 120B, 147, 148, 149, 323 of the Indian Penal Code, 1860 (for short, "IPC") and Sections 4 and 25 of the Arms Act, 1956.

The prosecution case is that, one Rahul Tanaji Patil along with his family resides at village Tadsoundane, Tal. Barshi, Dist. Solapur. His cousin brother Krushna Murlidhar Patil along with his
family resides in the same village. There was previous dispute between cousin brother of the informant namely Krushna Patil and Hanumant Borade and accused persons. The accused persons used to give threat to Krushna Patil. On 24.11.2017 at about 2:30 p.m., the informant went to John Deere Tractor showroom at Jamgaon road, Barshi for making the inquiry and returning back at 5:30 p.m. When he reached at Tilak chowk, Barshi, his cousin brother Dhananjay Patil was standing there. Thereafter, both of them were proceedings towards village Tadsoundane on his motorcycle. While they were proceeding to the village Tadsoundane, they met cousin brother Krushna Patil near brick furnace, who was also going to village on his motorcycle along with Manik Satpute and Sudam Chavan.
At that time, the accused Ganesh jadhav was coming with pick up vehicle from village side rashly and gave dash to the motorcycle of Krushna Patil. Due to that Krushna Patil, Manik Satpute and Sudam Chavan fell down. At that time, Vikas Borade, Rahul Borade, Balaji Survase, the applicant, Laxman Satpute, Pravin Chavan, Subhash Borade, Bapusaheb Borade, Vitthal Satpute and Ganesh Jadhav got down from the pickup vehicle. They were armed with sword, sickle, iron pipe, wooden rod. The accused Ganesh Jadhav thrown chilly powder in the eyes of Krushna Patil, Manik Satpute and Sudam Chavan. The accused No.1, 6 and 11 were armed with sickle. The Accused Nos.
and 8 armed with sword. The Accused No.2 armed with iron pipe. They assaulted to Krushna Patil, Manik Satpute and Sudam Chavan with sickles, swords, iron pipe and wooden rod. After seeing the informant coming towards them, all of them fled away from the spot. Due to assault by the accused persons Krushna Patil, Manik Satpute and Sudam Chavan had sustained grievous injuries. Thereafter, they were shifted to the hospital for treatment. But Krushna Patil was declared dead by the doctor. Manik Satpute died at about 8:30 p.m., while taking the treatment and Sudam Chavan was under the treatment at hospital. Thereafter, the informant lodged the report against the accused to Pangari Police Station. On his report, Crime No.294 of 2017 came to be registered.

Learned counsel Mr. Prashant Edake for the Applicant submits that the Applicant is falsely implicated in the present crime. The allegations made in the F.I.R. are taken to be true, the role attributed to the present Applicant is limited to fist and kick blows. The other eleven accused persons who were arrested, and were alleged of direct assault by means of dangerous weapon resulting into the death of Krushna Patil and Manik Satupute have already been released on regular bail. The Applicant is arrested on 27/11/2017 and he is behind bars since then. The trial is yet to commence and it would take sufficient time to conclude. The Applicant is not having
any criminal antecedents and is ready to abide by any conditions that may be imposed by this Court. Hence, the Applicant may be released on regular bail.

As against the learned APP strongly opposes the bail application on the ground that the Applicant is involved in the serious offfence of causing Unlawfully Assembly with a common object of committing murder. The Applicant is directly named in the F.I.R. to be one of the assailants who was member of unlawful assembly. The assault have resulted into death of two persons i.e. Krushna Patil and Manik Satpute, whereas one witness Sudam Chavan is seriously injured in the incident. The offence is punishable with death or life imprisonment. If the Applicant released on bail, he may tamper with the prosecution witnesses and thereby cause prejudice to the prosecution case. Hence, the application may be rejected. 6.
I have gone through the investigating papers which has culminated into filing of the charge-sheet. The Applicant is arrested on 27/11/2017. All other accused persons, who are directly attributed the role of assault by means of dangerous weapons like iron rod, sword, iron pipe and wooden stick have already been released on regular bail. The Applicant was arrested on 27/11/2017 and that there are several witnesses likely to be examined by the prosecution and the trial would take its own time to conclude and is
not likely to complete in near future. The further detention of the Applicant would amount to a pre-trial detention which is deprecated by the Hon'ble Supreme Court, hence I am inclined to release the Applicant on bail, and I pass the following order:-
ORDER
I. The application is allowed.
II. The Applicant - Shrihari Pandhari Satpute, be released on bail in connection with Crime No. 294 of 2017 registered with Pangari Police Station, Solapur Rural, for the offences punishable under Sections 302, 307, 120B, 147, 148, 149, 323 of the Indian Penal Code, 1860 (for short, "IPC") and Sections 4 and 25 of the Arms Act, 1956, he be released on bail on furnishing P.R. Bond of Rs.50,000/- (Rupees Fifty Thousand) with one or two solvent sureties in the like amount, on following conditions :- A) The Applicant shall attend the concerned police station as and when required by the Investigating Officer.
B)The Applicant shall attend each and every dates of the trial Court regularly unless exempted by the trial Court. C) The Applicant shall not tamper with the prosecution evidence and shall not influence the witnesses, in any manner. He shall not indulge in any cognizable offence. Any single reported incident involving the
Applicant shall entitle the prosecution to move for cancellation of bail.
D) The Applicant shall submit his Aadhar Card and Pan Card copy to the Investigating Officer and detailed addresses of the residence and phone numbers of himself and two of the near relatives. 7.
In view of the aforesaid terms and conditions, the application is allowed and accordingly stands disposed of. ( MEHROZ K. PATHAN, J.)
